Geneva, Switzerland (IP-Watch): The governments of Spain and Italy have filed complaints with the European Court of Justice naming for the annullment of a March European Council decision to make an EU unitary patent. The Council authorised “enhanced cooperation in the area of the creation of unitary patent protection” on 10 March (IPW, European Policy, 13 April 2011). Arguments include miss of competence and misuse of powers.
